Thank you for booking a safari with Enduata Camps Ltd. We hope you have an amazing time. Enduata Camps Ltd want to inspire complete confidence in you, so that when you book with us, you know you’re being looked after from beginning to end.
These Terms & Conditions, together with our privacy policy and any other written information we brought to your attention before we confirmed your booking, form the basis of your contract with the respective invoicing company (“we”, “us”, “our”). Please read them carefully as they set out the Parties respective rights and obligations. Making a booking with Enduata Camps Ltd is taken as acceptance by the customer of the Terms and Conditions. Making payment of your deposit also signifies acceptance of the terms and conditions:
The holidays featured on our website and written information are operated by Enduata Camps Ltd (hereinafter called “EC”, “we” or “us”), which is registered in Tanzania under number 179360888.
The following conditions will form part of your contract with Enduata Camps Ltd so please read them carefully before you book.
In these Terms & Conditions, references to “you” and “your” include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.
By making a booking, the first named person on the booking agrees on behalf of and has the authority to represent all persons detailed in the itinerary that:
- He/she has read these Standard Terms & Conditions, understands them, and agrees to be bound by them.
- He/she consents to our use of personal data in accordance with our Privacy Policy and is authorised, on behalf of all persons named on the booking, to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions, disabilities, and dietary requirements).
- He/she is over 18 years of age and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services.
- He/she accepts financial responsibility for payment of the booking on behalf of all persons detailed in the itinerary.
The law
The terms and conditions together with all correspondence form part of your contract with Enduata Camps Ltd. This contract and any matters arising from it shall be governed by and interpreted in accordance with UK law and the courts of the United Kingdom shall have exclusive jurisdiction to hear any and all proceedings between us either relating to our contract or arising out of it.
Payment terms
A 20% deposit is required to confirm the booking, along with written confirmation including traveller names, arrival details, board basis, rooming and dietary requirements.
The remaining balance will be due no later than 60 days before arrival in camp. Late or non-payment will be liable for cancellation charges as below.
Cancellation terms
In the event that you cancel your booking, in full or partially, for any reason whatsoever Enduata Camps Ltd will levy cancellation charges as defined below.
- Confirmation to 61 days before arrival: Deposit is forfeited.
- 60 – 31 days before arrival: 50% cancellation is due.
- 30 days – arrival: 100% cancellation will be charged.
Methods of Payment
Payments can be made by bank wire/transfer.
Website pricing
All prices published on enduatacamps.com are per person, based on two persons (unless otherwise stated) and quoted in US dollars (US$). Cost of obtaining passports or visas, border taxes (if applicable), tips for guide, driver and hotel staff, insurances, additional excursions or personal expenses are not included in the itinerary cost. Discount rates for children or peak-rates during the high/festive season are not included. All prices on the website should be used as a guideline only.
Enduata Camps Ltd cannot be held responsible for any changes or pricing errors. Enduata Camps Ltd will specify all costs in their invoices. The quotations are valid for 2 weeks.
Insurance
It is a condition of booking, that the sole responsibility lies with the guest to ensure that they carry the correct comprehensive travel and medical insurance to cover themselves, as well as any dependents/travelling companions for the duration of their trip to Tanzania. This insurance should include: medical expenses and repatriation expenses. Optional insurances are: cancellation or curtailment of the safari, emergency evacuation expenses (flying doctors), damage/theft/loss of personal baggage, money and goods. We reserve the right to cancel your holiday at any time should such a policy not be taken out by you.
Passports and visas
It is upon the guest to ensure that passports and visas are valid for the countries visited. Most nationalities can get a tourist visa on arrival in Tanzania at the border/airport (Approximately $50 per person). This tourist visa is valid for a period of three months. You can also get your visa in advance at the embassy in your home country or online. Check the visa rules before you go. Passports should have at least six months of validity after the final day of travel. Enduata Camps Ltd cannot be held liable for any visas, etc. not held by the guest, nor the cost of visas.
Medical conditions and disabilities
If you or any member of your party have any medical problem or disability which may affect your holiday, please tell us before you confirm your booking so that we can advise as to the suitability of the chosen arrangement. In any event, you must give us full details in writing at the time of booking. If we reasonably feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline the booking or, if full details are not given at the time of booking, cancel when we become aware of these details.
Documentation
Please carefully read your confirmation invoice and all other documentation we send you as soon as you receive them. Contact us immediately if any information appears to be incorrect as it may not be possible to make changes later. We regret we cannot accept any liability if we are not notified of any inaccuracy in any documentation within 14 days of our sending it out. You will be responsible for any costs and expenses involved in rectifying any inaccuracies except where we made the mistake.
Surcharges
Matters influencing a surcharge would include, but are not limited to, increases in transportation cost e.g. fuel, scheduled air fares and any other airline surcharges, taxes or fees payable for services such as landing taxes, or embarkation or disembarkation fees at port or airport, or increases in park fees, reserve fees or concession fees. The price of your itinerary will be based on known cost at the date of issue of the itinerary. At any time before a full payment of your holiday has been made Enduata Camps Ltd reserves the right to levy a surcharge where costs have changed since the date of issue of the itinerary.
We reserve the right to make changes to and correct errors in advertised prices at any time before your holiday is confirmed. We will advise you of any errors of which we are aware and of the then applicable price at the time of booking.
Amendments by Enduata Camps Ltd
It is unlikely that we will have to make any changes to your holiday although we reserve the right to make changes at any time. Most of these changes are minor and we will advise you of these in writing at the earliest possible date.
Compensation will not be payable and no liability can be accepted where we are forced to make a change or cancel as a result of unusual or unforeseen circumstances beyond our control, the consequences of which we could not have avoided even with all due care. No compensation will be payable if we cancel as a result of your failure to comply with any requirement of these booking conditions entitling us to cancel, or if the change is a minor one. A minor change is a change which, taking into account the information you give us at the time of booking or which we can reasonably be expected to know as a tour operator, we would not reasonably expect to have a significant effect on your confirmed holiday.
Cancellation by Enduata Camps Ltd
We reserve the right in any circumstances to cancel your holiday for any reason at any time before full payment has been received. Whilst we always endeavour to avoid changes and cancellations, we must reserve the right to do so. We may cancel your confirmed holiday if you fail to comply with any requirement of these booking conditions entitling us to cancel.
Force Majeure
We cannot accept liability or pay compensation where the performance or prompt performance of our contractual obligations is prevented or affected by, or you suffer any damage or loss as a result of force majeure. In these booking conditions force majeure means any event which we or the supplier of services in question could not even with all due care foresee or avoid.
Such events Enduata Camps Ltd are likely to include, but are not limited to, war, threat of war, civil strife, riot, civil disorder/unrest, industrial dispute, actual or threat of terrorist activity, natural or nuclear disaster, fire, breakout of an epidemic or pandemic disease, technical problems with transport, cancellation or amendment to any scheduled flight, closure or congestion of airport or port, adverse weather conditions and all similar events outside our control. In circumstances amounting to force majeure we will not refund any money to you although if we can recover any monies from our suppliers we will refund these to you.
The Company shall not be deemed to be in breach of these terms and conditions or otherwise be liable to the Client, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure.
If the Company is affected by Force Majeure it shall be entitled to, and may in its sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the tour or safari.
No refunds are given for circumstances arising beyond the Company’s control, necessitating alternative arrangements being made to ensure the safety and/or further participation and enjoyment of the tour or safari.
In the unlikely event of a vehicle breakdown that is beyond the Company’s control and immediate repair, the Company will arrange to have the spare part sent to the current location in the fastest possible time. The Company reserves the right to alter the itinerary accordingly in order to make up any time lost due to any unforeseen circumstances.
The company reserves the right to cancel the tour without prior notification and in such an event only agrees to refund all monies already paid and received from the Client.
Carriers
Carriage by air and sea is subject to the terms and conditions of the carriers with whom you are travelling and to international conventions. Enduata Camps Ltd accepts no liability whatsoever for cancellations, strikes, timetable changes, diversions, technical issues unrelated to Enduata Camps Ltd, lost or mislaid luggage, rescheduling costs, missed accommodation, or delays which result from any operational decision of the carrier concerned. Enduata Camps Ltd accepts no liability for death, injury or illness that derives from carriage by air or sea.
Problems
If you have a problem during your holiday, please inform the camp manager immediately and they will endeavour to put things right. If your problem cannot be resolved locally you must send full details to Enduata Camps Ltd in writing within 28 days of your return home. If you fail to follow this procedure, we will not accept liability as we have been deprived of the opportunity to investigate and rectify the problem.
Our responsibilities
Enduata Camps Ltd accepts responsibility for ensuring your holiday is supplied as described prior to your departure and services provided will reach a reasonable local standard.
Enduata Camps Ltd shall:
- Undertake the responsibility of planning and arranging itineraries, providing quotations, making reservations, and invoicing.
- Promptly supply the Guest with brochures, information and marketing material at EC’s disposal to assist the Guest in making informed decisions.
- Provide information on all accommodation, transfers and activities specified in the itinerary.
- Make every effort to secure guests preferences and special requests, noting that these cannot always be secured or guaranteed.
- Be entitled to change travel arrangements including accommodation and activities due to unforeseen circumstances after the itinerary has been issued. Should this occur EC will promptly notify the Guest of the changes to the itinerary. EC shall endeavor not to unnecessarily inconvenience the guest.
- NOT be responsible for any losses/costs incurred by the Guest resulting from inadequate, insufficient, or incomplete medical and travel insurance cover.
- Provide prompt appropriate assistance if, whilst during the itinerary, you are in difficulty for any reason. In particular, EC will provide you with appropriate information on health services, local authorities and consular assistance, and assistance with distance communications and finding alternative travel arrangements.
- Where you require assistance, which is not as a result of any failure by us, our employees or subcontractors we will not be liable for the costs of any alternative travel arrangements or other such assistance you require. Furthermore, we reserve the right to charge you a fee for our assistance in the event that the difficulty is caused intentionally by you or a member of your party, or otherwise through your or your party’s negligence.
- Reserve the right, from time to time, to amend these Terms and Conditions and/or any other special terms by notifying you in writing.
- EC shall not be held responsible for any damages caused to Guest clothing in using our laundry service in camp.
- EC is acting as facilitator and not as principal in relation to booking with third party suppliers such as accommodation or activities, and your contract is directly with such supplier – whilst we will seek to resolve issues between you and the third party, EC is not responsible for the delivery of their service or any failure of such third party supplier, including a failure to deliver such service caused by the insolvency of such a supplier.
Please note we cannot accept responsibility for any services which do not form part of our contract. The information contained in our brochure and website is correct to the best of our knowledge at the time.
We would remind customers that the infrastructure in developing countries may not be up to the same standard as other countries. Some resorts may experience the occasional power cut or water shortage.
Please note that we will not be responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:
- The fault of the persons affected or any members of their party.
- The fault of a third party not connected with the provision of your holiday, which we could not have predicted or avoided.
- An event or circumstances which we or the supplier of the services in question could not have predicted or avoided, even after taking all reasonable care (see force majeure).
In addition we will not be responsible where you do not enjoy your holiday or suffer problems because of a reason you did not tell us about when you booked your holiday, or where any problems you suffered did not arise from any breach of our contract, or other fault of ourselves or where we were responsible for them, our suppliers or agent or where any losses, expenses, costs or other sum you have suffered relate to any business.
We accept responsibility for the negligent acts of our employees, agents and direct suppliers, which results in death, injury or illness. Our liability shall be limited to 200% of the holiday price for any claim other than those involving injury or death arising from our negligence. Our suppliers, such as accommodation or transport suppliers, have their own booking conditions or conditions of carriage, and these conditions are binding between you and the supplier. Some of these conditions may limit or remove the relevant transport providers or other suppliers liability to you. You should also note that these conditions may limit or remove the carrier’s liability to you and the amount the carrier has to pay you. You should also note the carrier will rely upon its conditions of carriage, which may limit or remove the carrier’s liability to you and limit compensation under international conventions. Enduata Camps Ltd accepts liability as above only if a claim is notified to us in writing no later than one month after your return.
Guest Responsibilities
The Guest shall complete the Client Personal Booking Forms including detailing:
- Guests passport nationalities (required by certain national park authorities)
- Specific dietary requirements
- Confirmation of travel insurance that has been obtained for all Guests
- Any pre-existing medical conditions which you feel EC should be made aware of
- Any other special needs for consideration by EC. EC will inform the guest if such special needs can be met.
Guests also agree to:
- Be familiar with these terms and conditions and any amendment to the T&Cs as communicated by EC
- Promptly comply with any lawful and reasonable instruction given by EC and their designated representatives
- Promptly communicate with EC any requests regarding amendments, changes, or cancellations to itineraries in writing by email
- Ensure you have the necessary documentation to satisfy immigration, customs and port health authorities for all countries being visited. This should include passport (with sufficient pages and validity), visa, and proof of any required vaccinations
- Seek medical advice regarding vaccination requirements for countries into which travel is planned
- Acknowledge that your travel may take you into isolated remote areas and in close proximity with wildlife by signing the required waiver and indemnity forms provided by EC
- Behave in a way that is considerate of other guests and your shared enjoyment of the travel experience
- Ensure safe keeping of baggage and personal effects at all times
- Be solely responsible for ensuring that all payments due to EC are received on time in accordance with the terms and conditions
Other activities and excursions
Our brochure descriptions and other information provided or made available often refers to “other activities and excursions”, which are available. These activities and excursions are not run nor controlled in any way by EC. They do not form any part of your contract with EC, even where we suggest or recommend particular operators/centres/trips and assist you in booking such activities or excursions in any way.
Accordingly we regret that Enduata Camps Ltd cannot accept any liability in relation to these outside activities and excursions. Where we make or take any bookings for or from you in respect of any activity or excursion available, we do solely as booking agents. This is the case regardless of whether the activity is advertised or mentioned in our brochure, on our website or elsewhere. Your contract for any such activity or excursion will be with the supplier or operator of that activity or excursion. Enduata Camps Ltd has no liability for any such activity or excursion.
Liability
The Client hereby acknowledges, confirms and records that he/she understands the risk inherent in adventure travel in African destinations and associated activities. The client agrees and concedes that the Company, its representatives and employees shall not be responsible for loss or damage to possessions, or injury or illness to the client or loss of life or consequential damages which might occur from any cause whatsoever, unless directly caused by the Company’s negligence.
Indemnity, Waiver and Disclaimer
The Company’s camps are unfenced and are built to allow guests to enjoy the natural environment and are situated in Wildlife Areas. This presents real dangers and risks to guests of suffering bodily injury, illness and even death or damage to property arising from amongst other things travelling in an open vehicle, the presence of wild, unpredictable, and dangerous animals, insects, fish, and reptiles. Accordingly, entering a Wildlife Area and undertaking and/or participating in any Activity offered in these areas is done so entirely at the guests own risk.
The Company shall not be liable to the guest or any of their dependents, spouse, life partner, children, travel agent, tour operator, tour organiser or intermediary that organised or was involved in arranging the travel activities for any claim of whatever nature or cause in connection with the provision of the services (whether in contract or delict) and whether for damages for personal injury, illness (including but not limited to any communicable disease), harm, death or disability, loss of support, damages, and loss of property however arising, including acts of negligence.
Each guest will be required to sign a camp Indemnity, Waiver and Disclaimer form. Guests arriving at camp will receive a safety briefing and are required to acknowledge such safety briefing when signing the Indemnity, Waiver and Disclaimer form.
